By booking an excursion with Memories Asia Co., Ltd, you agree to the following terms and conditions:
1. Booking and Payment
a. All bookings must be made in advance via our website or by contacting us directly.
b. Full payment is required to secure your booking and can be made by credit/debit card (via Stripe), bank transfer, or cash.
c. All prices displayed in currencies other than Thai Baht (THB) are for reference only. The final payment will be processed in Thai Baht (THB), based on the exchange rate at the time of payment.
d. Once your booking and payment are received, a confirmation email or WhatsApp message will be sent to you.
e. The company reserves the right to cancel your booking if payment is not received in full and on time.
2. Cancellation and Refund Policy
a. You may cancel your booking and receive a full refund if you notify us at least 72 hours before the scheduled tour date.
b. No refunds will be given for cancellations made less than 72 hours before the tour date or for no-shows.
c. The cut-off time is 23:59 (GMT+7, Thailand time), three days before your tour date.
d. If we cancel a tour due to weather, safety, or other factors, you will be offered an alternative date or a full refund.
3. Tour Itinerary and Changes
a. Tour itineraries are subject to change or cancellation due to weather, traffic, or unforeseen circumstances.
b. We reserve the right to modify or cancel any part of the tour as necessary for safety or operational reasons.
c. We are not responsible for any costs incurred by you due to changes in the itinerary.
4. Customer Responsibilities and Safety
a. Please follow all instructions provided by our guides and staff during the tour.
b. You are responsible for your own safety, belongings, and ensuring your fitness for participation.
c. Please inform us of any medical conditions, allergies, or other issues that could affect your experience.
5. Liability
a. Memories Asia Co., Ltd acts solely as a booking agent for third-party tour and excursion operators (“Third-Party Providers”).
b. We do not operate, supervise, or control the excursions. All activities, services, and arrangements during the excursion are provided by the Third-Party Provider.
c. Memories Asia Co., Ltd is not liable for any loss, injury, accident, damage, delay, or irregularity resulting from the actions or omissions of any Third-Party Provider, except as required by law.
d. Customers participate in tours at their own risk and are responsible for their own safety and belongings during the excursion.
6. Travel Documents
a. You are responsible for obtaining any required travel documents, visas, or permits needed for your excursion.
b. We are not responsible for any consequences or costs resulting from missing documents.
7. Personal Belongings
a. You are responsible for your personal belongings.
b. We are not liable for any loss, theft, or damage to your items during the tour.
8. Privacy Policy
a. We respect your privacy and only collect personal data needed to process your booking and provide services.
b. We will not share your personal information with third parties without your consent, except as required for your booking.
c. We may use customer feedback and reviews for promotional purposes.
9. Governing Law
a. These terms and conditions are governed by the laws of Thailand.
b. Any disputes will be resolved by the courts of Thailand.
